Terms & Conditions

1. Agreement Overview

By purchasing advertising space on FRSHR water bottles, the Advertiser agrees to comply with these Terms and Conditions and all applicable Australian laws.

 

2. Advertising Approval

All advertising content is subject to approval by FRSHR. We reserve the right to reject or remove any content deemed inappropriate, misleading, offensive, or non-compliant with Australian Consumer Law or any other applicable legislation.

3. Content Submission

  • Advertisers must supply final artwork by the deadline provided by FRSHR.
  • Content must meet FRSHR’s technical and design specifications.
  • FRSHR is not responsible for delays caused by late or incorrect submissions.

4. Payment Terms

  • A full payment is required prior to production and distribution unless otherwise agreed upon in writing.
  • All pricing is in Australian Dollars (AUD) and includes GST where applicable.
  • Late payments may result in production delays or cancellation of advertising placement.

5. Distribution & Exposure

  • FRSHR guarantees the distribution of branded water bottles at pre-determined events and venues across Melbourne.
  • While we strive to meet agreed distribution targets, actual audience reach and engagement may vary.
  • FRSHR reserves the right to alter event schedules, venues, or distribution timelines due to weather, venue changes, or other factors beyond our control.

6. Intellectual Property

  • Advertisers retain ownership of submitted content.
  • By providing advertising materials, the Advertiser grants FRSHR a non-exclusive, royalty-free licence to reproduce and distribute the content for the campaign duration.
  • The Advertiser warrants that the content does not infringe upon any third-party rights under Australian law.

 

7. Cancellations & Refunds

  • Cancellations must be made in writing to FRSHR.
  • Cancellations made more than 14 days before the scheduled event may be eligible for a 50% refund.
  • No refunds will be provided for cancellations within 14 days of the scheduled campaign start.
  • If FRSHR cancels an event or distribution due to unforeseen circumstances, the Advertiser will be offered an alternative placement or a full refund.

 

8. Limitation of Liability

  • FRSHR is not liable for any indirect, incidental, or consequential losses arising from ad placement, event changes, or campaign performance. FRSHR’s total liability shall not exceed the amount paid by the Advertiser.
  • FRSHR is not responsible for reach of the campaign and the individuals that the bottles are given to.

 

9. Indemnification

The Advertiser agrees to indemnify and hold harmless FRSHR and its affiliates from any claims, liabilities, or expenses arising from the advertisement content or breach of these Terms and Conditions.

 

10. Legal Compliance

The Advertiser is responsible for ensuring that all submitted advertising complies with:

  • The Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth))
  • The Australian Association of National Advertisers (AANA) Code of Ethics
  • Any applicable industry-specific advertising standards

 

11. Modifications

FRSHR reserves the right to amend these Terms and Conditions. Material changes will be communicated to current advertisers via email.

 

12. Governing Law

These Terms and Conditions are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

While FRSHR strives to offer a unique advertising channel, we cannot guarantee specific outcomes.

By purchasing an advertising package from FRSHR, the Advertiser acknowledges and agrees that they retain full ownership of all content submitted for the campaign. However, by providing advertising materials, the Advertiser grants FRSHR a non-exclusive, royalty-free licence to use, reproduce, and distribute the content solely for the purposes of delivering and promoting the agreed-upon campaign, for the duration of that campaign. The Advertiser also warrants that all submitted content is original or appropriately licensed, and does not infringe upon any intellectual property rights, moral rights, or other legal entitlements of any third party under Australian law.

Advertisers are required to submit all campaign content to FRSHR within 14 days of making payment for their selected advertising package. Timely submission ensures that campaigns can be scheduled and delivered as agreed. FRSHR reserves the right to make reasonable amendments to the submitted advertising content in order to maintain quality, adhere to platform guidelines, or improve clarity and effectiveness. Should any changes be made, FRSHR will promptly notify the Advertiser, providing a summary of the modifications along with a clear explanation for why they were necessary. This collaborative approach helps ensure campaigns are both effective and aligned with FRSHR’s standards.
